Services Offered

David R. Badger, P.A. specializes in various aspects of financial distress and bankruptcy law, providing comprehensive solutions for both individuals and businesses. Their primary services include:

  • Chapter 7 Bankruptcy: This is a liquidation bankruptcy designed to discharge most unsecured debts, such as credit card debt, medical bills, and other past-due bills. The firm guides clients through the "Means Test" to determine eligibility and helps them understand which assets are protected by exemptions, aiming for a true "fresh start."

  • Chapter 13 Bankruptcy: Often referred to as a "wage-earner's plan," Chapter 13 allows debtors with regular income to propose a plan to repay all or part of their debts over three to five years. This is frequently used to stop home foreclosures or vehicle repossessions by allowing clients to pay mortgage or vehicle arrearages through the plan.

  • Bankruptcy-Related Litigation: While not every bankruptcy case involves litigation, disputes can arise. David R. Badger is an experienced trial attorney and litigator who represents clients in adversary proceedings and other legal actions that may stem from bankruptcy cases. His expertise in litigation helps to prevent unnecessary and costly court battles for his clients.

  • Non-Bankruptcy "Workout" Matters: Recognizing that bankruptcy isn't always the best or only solution, the firm also assists clients in negotiating non-bankruptcy workout plans with creditors. This can involve debt settlement, restructuring payments, or other strategies to resolve financial issues without formal bankruptcy filings.

  • Creditor Representation: Beyond representing debtors, David R. Badger, P.A. also represents the interests of creditors, strategic asset purchasers, and litigants in bankruptcy cases. This broad perspective allows them to understand all sides of a financial dispute, which can be advantageous in achieving favorable outcomes for their clients.

Our experience with David Badger and his staff was outstanding. I had enormous medical bills after cancer surgery and a MRSA infection acquired during surgery (resulting in 2 more surgeries) because a diasagrement between my spouse's medical insurance coverage and Medicare resulted in bills that should have been paid by my spouse's medical insurance with Medicare as secondary coverage were forced onto Medicare only. After substantial struggles to try to pay all bills responsibly and failing to get the primary insurance to take responsibility, we went to David Badger who advised Chapter 7 bankruptcy protection. We live in our same home and have our same vehicles, but were successfully relieved of the debts we should not have had in the first place. I continue my efforts to get the original mistake corrected but at the point it's unlikely to be successful. David Badger and his staff were clear, articulate, organized, gave excellent advice and counsel, and represented us at the bankruptcy hearing successfully. I continue to ask for his counsel when issues arise as a result of the bankruptcy, and he and his staff are enormously helpful years later. I believe he and his firm are extraordinary in terms of legal education, legal advice, integrity, and helpfulness. He made a very painful experience in our lives understandable and much less stressful.

If you like money, STAY AWAY FROM THIS LAW FIRM. If you are in financial distress, or need bankruptcy assistance, I urge you to NOT use this firm. Please do yourself a favor and spend 5-10 minutes looking around Charlotte and you will thank me later. Our family had an absolutely terrible experience with this firm, particularly Ross Bromberger, one of the associates here. First, they wanted roughly $1800, TWICE the cost of a normal fee if you spend even 10 minutes price shopping. Long story short, we paid the fee. Fast forward 8 months later, the case was never filed (not the firm's fault, we were weighing options) - we had simply decided to not pursue/file and asked for a refund of our money. Ross tried to keep HALF the money even though the case was never filed! Are you kidding me? And you pretend like you're trying to help people? In my opinion, we felt like we had been robbed. After MUCH fighting/bickering (in the office mind you, with two screaming children), we were given back a few hundred bucks (still out of pocket almost 400 dollars!). An "invoice" was shown, detailing charges for a emails/phone call and other stuff I couldn't even recognize. In my opinion, this is simply not professional. I hope this young man learns from this experience as I do not think you can treat people this way and expect to stay in business very long. I should have known this place was not professional when they had CATS roaming around the front of the office! Yuck!!!! GO ELSEWHERE.
